3. Euro Trade Group Adam Pelka maintains the right to reject the registration application described in point 1 without providing justification.

4. By submitting confidential information, access to the online system is obtained.

5. Information necessary for logging into the online sale system must be kept confidential and not discclosed to third party.

6. The full responsibility for the damage caused by third parties to whom the data indicated it point 4 was disclosed, lies with the User who disclosed this data.

7. Disclosing personal data indicated in point 4 to third parties constitutes an infringement of these Terms and Conditions and result in denial of an access to the online sales system from the User.

8. Euro Trade Group Adam Pelka shall not be responsible for failures of the online sales system, caused in particular by its maintenance or malfunctions.

9. Euro Trade Group Adam Pelka may update the online sales system at any time.

10. Euro Trade Group Adam Pelka reserves the right to reject the complaint regarding the merchandise ordered via the online sales system when: a) mechanical damage resulted from alterations, repairs and changes made by the User or a third party; b) damage of the merchandise occurred as a result of installation or use other than indented.

11. The User shall not copy and distribute the contents and photos from the online sales system of Euro Trade Group Adam Pelka.

12. Euro Trade Group Adam Pelka is the owner of all copyrights to the contents of the online sales system.

13. Euro Trade Group Adam Pelka shall not be responsible for the content uploaded to the websites to which hyperlinks published in the online sales system lead.

14. Original numbers used in the online sales system were used only for information purposes.

15. Euro Trade Group Adam Pelka informs that in the website of the online sales system product description may contain errors which shall not constitute basis for possible claims against Euro Trade Group Adam Pelka. 21. By placing the order, the User concludes a remote agreement with Euro Trade Group Adam Pelka, and expresses their consent to the processing of their personal data.

22. At any time, the user has the right to access their personal data, amend, remove, or restrict or object to its processing, as well as the right to transfer it.

23. Personal data collected in the database of Euro Trade Group Adam Pelka is processed for the purpose of the completion of orders, the performance of the legal responsibility imposed on the controller, maintaining contact with Customers, conducting marketing via electronic means or by phone, according to the submitted consent, as well as purposes resulting from legitimate interests executed by the data controller, and such data will not be disclosed to other entities.

24. In the event circumstances make it entirely or temporarily impossible to complete the places order, Euro Trade Group Adam Pelka reserves the right to suspend the completion of the order.

25. Prices of the merchandise in the offer are given in PLN. Prices are net prices and they do not include VAT.

26. Sales via the online sales system are governed by general Sales Terms and Conditions available after logging in.

27. Euro Trade Group Adam Pelka issues VAT invoices for all products purchased via the online sales system.

28. The User can place the order for the products of Euro Trade Group Adam Pelka published on the website and featured in printed of PDF catalogues.

29. The User can order products which are not featured in the online sales system, but available in the offer of companies cooperating with Euro Trade Group Adam Pelka. In such an event, the User, based on catalogues in their possession, places an order by entering its description in the provided space in the order placed via the online sales system.

30. The order is placed by the User online, via forms available in the online sales system.

32. Euro Trade Group Adam Pelka shall not lease products for testing. Therefore, requests to cancel the sales agreement on these grounds shall be rejected.

34. Delivery of products indicated by the User in the order is performed in the manned selected by the user from shipping methods proposed by Euro Trade Group Adam Pelka.

35. The purchased merchandise shall be delivered to the address indicated in the order form.

39. Euro Trade Group Adam Pelka represents that the parts sold should be installed in the devices only by a qualified staff of a maintenance service for gardening, forestry or construction equipment.

40. Disputes arising from infringements of these Terms and Conditions shall be settled by the court competent for the seat of Euro Trade Group Adam Pelka.

41. The content of the Euro Trade Group Adam Pelka online sales system does not constitute a commercial offer within the meaning of the Art. 66 and Art. 543 of the Civil Code.
